These Terms of Service ("Terms") govern your use of the websites located at burns1876.com and burnssaddlery.com (the "Site") and the purchase of products through the Site, operated by Burns Holdings ("Burns", "we", "us", or "our"). By accessing or using the Site, placing an order, or otherwise engaging with our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years of age to use this Site and place an order. By using the Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
2. Products and Pricing
We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. Prices are listed in US dollars and are subject to change without notice. We are not responsible for typographical errors in pricing or product descriptions. If a pricing error is discovered after an order is placed, we will notify you and give you the option to proceed at the correct price or cancel your order.
We make every effort to display product colors and materials accurately, but we cannot guarantee that your screen will render colors exactly as they appear in person. Handcrafted products may have minor natural variations that are a characteristic of the materials and craftsmanship — these are not defects.
3. Made to Order Products
Many Burns products — including custom hats, boots, belts, and saddles — are made to order. Made to Order products are crafted specifically for you after your order is placed. By placing an order for a Made to Order product, you acknowledge and agree that:
- Production times vary and will be communicated at the time of purchase or upon request.
- Made to Order products are not eligible for return or exchange except in the case of a verified manufacturer defect, as described in Section 6 below.
- Cancellations of Made to Order products must be requested within 24 hours of placing your order. After production has begun, cancellations cannot be accepted.
- Merchandise that has been monogrammed, modified, or customized upon customer request is not eligible for refund or exchange under any circumstances.
4. Order Acceptance and Payment
Placing an order on our Site constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud. You will receive an email confirmation when your order is accepted.
Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout. Burns does not accept C.O.D. (cash on delivery) packages. All transactions are processed securely through our payment processor and Burns does not store your full payment card details.
5. Shipping
We ship domestically within the United States and internationally. Shipping rates and estimated delivery times are provided at checkout and may vary by destination, carrier, and product type.
For international orders, you are responsible for any customs duties, import taxes, or fees imposed by your country. Burns is not responsible for delays caused by customs processing.
Burns is not responsible for packages that are lost, stolen, or damaged during shipment. We strongly recommend that you insure your shipment and use a carrier that provides tracking. We can only assist with lost or stolen shipments if a tracking number has been assigned.
6. Returns and Exchanges
Can I Return My Purchase for Exchange or Refund?
We want you to love your purchase, so if something is not right, please let us know. We will be happy to exchange the product for another size, color, or a new style. And if you still cannot find what you are looking for, we will give you a full refund. We are committed to finding you the right product to fit your needs.
Conditions for Exchanges and Returns
The following conditions must be met for exchanges and returns:
- Product must not show any evidence of wear, and the original tags must be attached.
- Items must be unwashed and unworn.
- Boot exchanges or returns may be made if the boots are in as-new condition, with unmarked soles. When trying on your new boots, walk in clean, carpeted areas until you are sure that your boots fit correctly.
- Item must be returned within 10 days of receiving your order.
- There are no returns or exchanges on Final Sale merchandise, online or in-store. Final Sale items will be noted in web descriptions or on tagged items in-store.
- Merchandise that has been monogrammed, modified, or customized upon customer request is not eligible for refund or exchange.
- Made to Order products are not eligible for return or exchange except in cases of verified manufacturer defect.
Shipping Returns and Exchanges
We strongly recommend that you insure your package and use a prepaid, tracked shipping method when returning items through UPS or USPS. Burns is not responsible for packages lost or damaged in return transit without tracking.
To process your return or exchange, include the following with your shipment:
- A copy of the packing slip, invoice, or printed order confirmation, with exchange or return items marked.
- A Return Authorization (RA#) Number for faster processing. To request your RA#, call Burns Customer Service at 1-800-453-1281 and speak with any sales representative. Clearly mark the RA# on the outside of your package.
- A note documenting the reason for the exchange or return.
- Pack your shipment securely in original packaging if possible.
Send the package to the store it was purchased from. All online purchase exchanges and returns must be sent to:

Please allow 2–4 weeks for the return to be processed. If you are to receive a credit on your credit card, allow one to two billing cycles for the credit to appear on your statement. If there is a difference in the amount owed for exchanged merchandise, your credit card will be charged or credited accordingly when the replacement merchandise is shipped. You will receive an email confirmation or phone call when your return has been processed.
In-Store Returns and Exchanges
You may return your purchase to any Burns store location for exchange or refund. You must bring a printed copy of the order or purchase receipt along with the merchandise. Any return without a receipt will be issued as in-store credit.
Defective Merchandise
Merchandise that has failed due to a manufacturer defect may be returned for exchange, upon availability, or for credit. Products that have failed as a result of abuse or normal wear and tear are not eligible for refund or exchange.
7. Burns Workmanship Guarantee
Your Burns product has been carefully crafted by expert hands in Salina, Utah, using the highest-quality materials available. Each item has been designed and constructed with meticulous attention to detail. We take pride in our company's heritage and guarantee our workmanship lives up to our heirloom-quality standards. If the construction or finish of your Burns product does not meet Burns' quality standards, we will repair or replace the product accordingly.
The Workmanship Guarantee does not cover normal wear and tear of your Burns product.
8. Intellectual Property
All content on this Site — including but not limited to text, photographs, product images, logos, trademarks, graphics, and design — is the property of Burns Holdings or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or use any content from this Site without our prior written permission.
The Burns name, Burns 1876 name, and associated logos are trademarks of Burns Holdings. Unauthorized use of our trademarks is prohibited.
9. User Conduct
By using this Site you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Site or its related systems.
- Transmit any content that is harmful, offensive, or infringes the rights of others.
- Use automated tools to scrape, crawl, or extract data from the Site without our written consent.
- Misrepresent your identity or impersonate another person or entity.
10. Third-Party Links
Our Site may contain links to third-party websites. These links are provided for your convenience only. Burns has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
11. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Burns does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Burns Holdings and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by law.
13. Indemnification
You agree to indemnify and hold harmless Burns Holdings and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Sevier County, Utah.
For international customers, you agree that any disputes will be resolved under US law and in Utah courts, regardless of your country of residence.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
